Terms of Service

These Terms of Service ("Terms") govern access to and use of Verifyman services, including website, dashboard, APIs, and verification workflows. By accessing or using our services, you agree to these Terms.

1. Parties and definitions

"Verifyman" means Verifyman Technologies Pvt Ltd. "Customer" means the organization using our services. "End user" means the individual whose data is being verified.

2. Services

We provide identity and background verification services, including but not limited to identity checks, employment verification, education verification, address verification, criminal record screening, and related compliance workflows.

3. Eligibility and authority

Customers must be legally competent entities and must ensure authorized use of our platform by their personnel. Customers are responsible for account credentials and all actions performed through their accounts.

4. Lawful use and consent obligations

• Customer must collect valid consent and provide legally compliant notice to end users before initiating verification.
• Customer must not use services for unlawful discrimination, surveillance abuse, or prohibited activity.
• Customer is responsible for determining suitability of verification outcomes for decision-making.

5. Compliance framework

Services are intended to support compliance with applicable Indian laws, including the Digital Personal Data Protection Act, 2023, Information Technology Act, 2000, and other sector-specific requirements, subject to proper use by customer.

6. Data handling and privacy

Data handling practices are described in our Privacy Policy. Customer acts as data fiduciary/controller where applicable, and Verifyman acts as service provider/processor for customer-directed workflows, except where we operate independently under law.

7. Third-party sources and government records

Verification may involve trusted third-party databases, institutions, employers, and lawful public/government records. We do not guarantee uninterrupted availability of external sources beyond our control.

8. Accuracy and limitations

We use reasonable efforts and layered validation methods, but verification outputs are provided on an "as available" basis and may depend on source-system timeliness, completeness, and legal availability.

9. Fees and payment

Fees, billing cycles, taxes, and payment terms are governed by customer order forms, commercial agreements, or plan details communicated by Verifyman.

10. Intellectual property

Verifyman retains all rights in platform technology, software, reports format, and branding. Customer retains rights in customer-owned data and permitted outputs.

11. Confidentiality

Both parties must protect confidential information and use it only for agreed business purposes, except where disclosure is legally required.

12. Prohibited actions

• Attempting unauthorized access, scraping, reverse engineering, or service abuse.
• Uploading malicious content or using services to violate rights of any person.
• Using verification data for unlawful profiling or non-compliant employment practices.

13. Suspension and termination

We may suspend or terminate access for material breach, non-payment, security risk, legal non-compliance, or misuse. Customer may terminate as per contract terms.

14. Indemnity and liability

Each party is responsible for its own legal violations and third-party claims arising from misuse or breach of obligations. To the extent permitted by law, Verifyman's aggregate liability is limited to fees paid for affected services in the preceding contract period.

15. Disclaimer

Verifyman is a private company and not a government authority. Services do not constitute legal advice or guaranteed government certification unless explicitly issued by a competent authority.

16. Governing law and jurisdiction

These Terms are governed by the laws of India. Courts in Bengaluru, Karnataka shall have exclusive jurisdiction, unless otherwise agreed in writing.
